This book is a collection of secondary essays on America's most important philosophic thinkers—statesmen, judges, writers, educators, and activists—from the colonial period to the present. Each essay is a comprehensive introduction to the thought of a noted American on the fundamental meaning of the American regime.

Physicalism has, over the past twenty years, become almost an orthodoxy, especially in the philosophy of mind. Many philosophers, however, feel uneasy about this development, and this volume is intended as a collective response to it. Together these papers, written by philosophers from Britain, the United States, and Australasia, show that physicalism faces enormous problems in every area in which it is discussed. The contributors not only investigate the well-known difficulties that physicalism has in accommodating sensory consciousness, but also bring (...) out its inadequacies in dealing with thought, intentionality, abstract objects, , and principles of both theoretical and practical reason; even its ability to cope with the physical world itself is called into question. Unfortunately, an at least equally important and fundamental dispute among intensionalists themselves has tended to be blurred and/or ignored, with the result that many, perhaps most, contemporary philosophers are either inconsistent or vague on the issue.

This article advocates a naturalist and realist ethics of solidarity. Specifically, it argues that human needs should be met; and that they should be met in harmony with the environment. Realism should include respect for existing cultures and the morals presently being practiced – with reasonable exceptions. Dignity must come in a form understood and appreciated by the person whose dignity is being respected. It is also argued that naturalist ethics are needed to combat liberal ethics, not least because the (...) latter supports today’s inflexible and dysfunctional institutions. In arguing for these positions, reference is made to the naturalist realist ethics of Georges Canguilhem, C.H. Waddington, John Dewey and David Sloan Wilson, all of whom embed the social order in the natural order. (shrink)

ABSTRACTThis paper strengthens Bhaskar’s case for the possibility of naturalism. Building on Bhaskar’s A Realist Theory of Science and The Possibility of Naturalism, and on more recent contributions by Douglas Porpora, it traces the evolution of Bhaskar’s concept of 'intransitive' and follows his suggestion to treat social structure as an intransitive generative mechanism analogous to the generative mechanisms of the natural sciences. It is suggested, building on Porpora, that the constitutive rules of the market are usefully regarded as generating an (...) intransitive 'basic social structure.' That this same intransitive object is reasonably regarded as continuing to exist and act under different descriptions is illustrated by citing how different scholars have approached it with different concepts and vocabularies. It expands on Bhaskar’s first example of an intransitive object of social science, the mass unemployment that provided a ‘motor’ for Keynes, and on Porpora’s examples of the causal powers of social structures. Research on human genetic variation can present collective risks to all members of a socially identifiable group. Research that associates race or ethnicity with a genetic disposition to disease, for example, presents risks of group discrimination and stigmatization. To better protect against these risks, some have proposed supplemental community-based reviews of research on genetic differences between populations. The assumption behind these appeals is that involving members of study populations in the review process can help to identify and minimize collective risks (...) that otherwise could go unnoticed. In contrast to this position, critics have argued that supplemental community-based reviews are unnecessary, impractical, and morally problematic. BACKGROUND Patients with chronic pain face significant barriers in finding clinicians to manage long-term opioid therapy (LTOT). For patients on LTOT, it is increasingly common to have them sign opioid treatment agreements (OTAs). OTAs enumerate the risks of opioids, as informed consent documents would, but also the requirements that patients must meet to receive LTOT. While there has been an ongoing scholarly discussion about the practical and ethical implications of OTA use in the abstract, little is known about how clinicians (...) use them and if OTAs themselves modify clinician prescribing practices. OBJECTIVE To determine how clinicians use OTAs and the potential impacts of OTAs on opioid prescribing. DESIGN We conducted qualitative analysis of four focus groups of clinicians from a large Midwestern academic medical center. Groups were organized according to self-identified prescribing patterns: two groups for clinicians who identified as prescribers of LTOT, and two who did not. PARTICIPANTS 17 clinicians from General Internal Medicine, Family Medicine, and Palliative Care were recruited using purposive, convenience sampling. APPROACH Discussions were recorded, transcribed, and analyzed for themes using reflexive thematic analysis by a multidisciplinary team. KEY RESULTS Our analysis identified three main themes: (1) OTAs did not influence clinicians’ decisions whether to use LTOT generally but did shape clinical decision-making for individual patients; (2) clinicians feel OTAs intensify the power they have over patients, though this was not uniformly judged as harmful; (3) there is a potential misalignment between the intended purposes of OTAs and their implementation. CONCLUSION This study reveals a complicated relationship between OTAs and access to pain management. While OTAs seem not to impact the clinicians’ decisions about whether to use LTOT generally, they do sometimes influence prescribing decisions for individual patients. Clinicians shared complex views about OTAs’ purposes, which shows the need for more clarity about how OTAs could be used to promote shared decision-making, joint accountability, informed consent, and patient education. The repertory grid method was used to determine what terminology respondents use to distinguish between different applications of genetic engineering drawn from food- related, agricultural, and medical applications. Respondents were asked to react to fifteen applications phrased in general terms, and results compared with a second study where fifteen more specific applications were used as stimuli. Both sets of data were submitted to generalized Procrustes analysis. Applications associated with animals or human genetic material were described as causing ethical concern, being (...) unnatural, harmful, and dangerous. Those involving plants or microorganisms were described as beneficial, progressive, and necessary. The results were validated in survey research, which indicated that general applications ofgenetic engineering were perceived as either positive or negative, whereas specific applications were more highly differentiated in perceptual terms. The results imply that the public debate about genetic engineering must take due account of the complexity of public concerns. (shrink)

Dubbed “Nietzsche without his hammer” by literary critic James Wood, the Romanian philosopher E. M. Cioran is known as much for his profound pessimism and fatalistic approach as for the lyrical, raging prose with which he communicates them. Unlike many of his other works, such as _On the Heights of Despair_ and _Tears and Saints_, _The New Gods_ eschews his usual aphoristic approach in favor of more extensive and analytic essays. Returning to many of Cioran’s favorite themes, _The New Gods (...) _explores humanity’s attachment to gods, death, fear, and infirmity, in essays that vary widely in form and approach. In “Paleontology” Cioran describes a visit to a museum, finding the relatively pedestrian destination rife with decay, death, and human weakness. In another chapter, Cioran explores suicide in shorter, impressionistic bursts, while “The Demiurge” is a shambolic exploration of man’s relationship with good, evil, and God. All the while, _The New Gods _reaffirms Cioran’s belief in “lucid despair,” and his own signature mixture of pessimism and skepticism in language that never fails to be a pleasure. Perhaps his prose itself is an argument against Cioran’s near-nihilism: there is beauty in his books. (shrink)

Strategies for protecting historically disadvantaged groups have been extensively debated in the context of genetic variation research, making this a useful starting point in examining the protection of social groups from harm resulting from biomedical research. We analyze research practices developed in response to concerns about the involvement of indigenous communities in studies of genetic variation and consider their potential application in other contexts. We highlight several conceptual ambiguities and practical challenges associated with the protection of group interests and argue (...) that protectionist strategies developed in the context of genetic research will not be easily adapted to other types of research in which social groups are placed at risk. We suggest that it is this set of conceptual and practical issues that philosophers, ethicists, and others should focus on in their efforts to protect identifiable social groups from harm resulting from biomedical research. There is also a section on Marx's hints concerning what a just distribution of property would be, in which a method is suggested for combining consumer choice in selecting what to produce with the use of a labor theory in planning production. ;The analysis of the labor theory is embedded in the context of the justifications commonly given for existing capitalist distributions of property. Part of this context is a critique of the argument from freedom, i.e. of positions which justify (...) entitlements by citing free agreements and freely given gifts. Part of the context is a critique of the anti-ideology argument, i.e. of positions which justify institutional arrangements on the ground that they function to encourage investment and production. ;This dissertation uses Aristotle's conception of distributive justice as a framework for analyzing Karl Marx's labor theory of value. The appeal to traditional principles of justice is found to be implicit in Marx's scientific arguments. Marxist texts, mainly Capital, are found to contain five kinds of arguments in favor of the labor theory of value. That the only attribute all commodities have in common is that they are products of labor. That labor determines price. That labor determines natural prices. That from a social point of view the value of a commodity ought to be considered equal to the portion of society's effort than went into it. That the concept of labor-value makes it possible to construct a theory which explains a wide range of economic phenomena. (shrink)

In El Salvador from 1978 to 1988, contraceptive use among married women 15–44 years of age increased from 34% to 47%, and the total fertility rate declined from 6·3 to 4·6 children per woman. Most of this change took place from 1978 to 1985. Sterilization is the most prevalent method used, but nearly one-half of the women who are sterilized did not use any contraception before their operation. Few young couples use reversible methods of contraception to space births or delay (...) the start of childbearing. Source credibility has been thought to bean important determinant of peoples‘ reactions toinformation about technology. There has also been muchdebate about the need to communicate effectively withthe public about genetic engineering, particularlywithin the context of food production. Questionnaireswere used to investigate the impact of sourcecredibility, admission of risk uncertainty, andinitial attitude towards genetic engineering onattitudes of respondents after information provision.120 respondents with positive attitudes towardsgenetic engineering in food production were providedwith persuasive information about the technology,where both source attribution and admission (...) of riskuncertainty were systematically varied within theexperimental design. Impact on perceptions of sourcecredibility, informational qualities, and postintervention attitudes were examined, and compared toa second group of respondents who held initiallynegative attitudes towards genetic engineering, andwho had been exposed to similar informationinterventions. As predicted by Social Judgment Theory,initial attitude was found to be an importantdeterminant of post-intervention attitude. However,admission of risk uncertainty was also found to beinfluential in increasing acceptance and reducingrejection of the technology, possibly through thefacilitation of elaborative processing. Contrary toprevious research, prior attitudes had an impact onperceptions of both source credibility andinformational quality. In terms of effectiveinformation provision about genetic engineering, itwas concluded that scientific honesty is the bestpolicy, and that lay understanding of scientificprocess is probably greater than hitherto assumed byexperts. Genomic research projects that collect tissues from deceased organ and tissue donors must obtain the authorization of family decision makers under difficult circumstances that may affect the authorization process. Using a quasi-experimental design, the Ethical, Legal, and Social Issues (ELSI) substudy of the Genotype-Tissue Expression (GTEx) project compared the recall and understanding of the donation authorization process of two groups: family members who had authorized donation of tissues to the GTEx project (the comparison group) and family members who had authorized (...) organ and tissue donations in years previous, who subsequently participated in two different mock-authorization processes that mimicked the GTEx authorization process (the intervention groups). Participants in the comparison and intervention groups were matched on key demographic characteristics.We found that participants in the intervention groups who experienced a mock-authorization process demonstrated better recall of the tissue donation request than members of the comparison group. Our data indicate that the stress associated with the loss of a loved one limited the ability of family members to recall details about the GTEx project. However, we found a similar lack of knowledge in both the comparison and the intervention group participants, suggesting lack of knowledge may be due to the complexity and unfamiliarity of the information presented to them during the authorization process. We discuss these findings in the context of everyday clinical decision making in cognitively challenging conditions. (shrink)
